www.bbspartysupplies.com is the online shopping website where you can browse and purchase products from BBs Party Supplies and Cake Decorations ABN 49 769 224 430 (‘BBs’).
The use of www.bbspartysupplies.com (the ‘site’) is governed by the policies, terms and conditions below. Please read them carefully. Your use of this site indicates your acceptance of our terms and conditions. By placing an order, you indicate your acceptance of our terms and conditions.
BBs Party Supplies reserves the right to make changes to this site and these terms and conditions at any time.
By ordering at www.bbspartysupplies.com you grant us the right to add your contact details to our database and email transactional order, shipping and review emails. Please view our privacy policy for details on how your information is used and stored. We will never spam you, but we may contact you about new offers, products etc. You may unsubscribe from any and all correspondence. This can be done merely by emailing us at sales@balloonsbrisbane.com.au or choosing the unsubscribe button on any online newsletter or catalogues etc.
Order Policy
You may place an order through the ‘site’ to order your goods. You will receive a confirmation of your order. This order confirmation indicates the order has been received by BBs but does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. BBs reserves the right at any time after receipt of your order to accept or decline your order for any reason. We also reserve the right to supply a lesser quantity than your order without prior notification. However, we always strive for great communication, so we will always endeavor to let you know what is going on.
Upon cancellation of an order, we will make all reasonable attempts to contact you using the details provided. All received monies will be refunded using the method received.
We at BBs are very conscious of making our customers happy. We advertise our products in good faith that our warehouse has the quantity available. Unfortunately like all retail businesses we occasionally have less stock than anticipated. We will let you know as soon as possible if there are any issues with supplying your order. At that time, you can take one of two actions.
- We will issue a store credit for any goods not supplied. This credit is valid for 12 months from order date. Once stock is available, we will forward the products to you at no additional charge, or
- If you would prefer, we will issue a full refund to the source of your original payment.
Risk
Risk and title in the products ordered passes to you on the date and time of delivery to the delivery address.
Cancelling an Order
You may cancel an order which has not been dispatched by calling (04) 1445-9367. If the order has been dispatched, you may return the unopened goods for a full refund to value of product or store credit upon receipt, at your cost of return (excluding special orders, bouquets and balloon arrangements).
Incomplete Order
On receipt of order, please check the contents against your invoice. Should any items be missing and not noted as on backorder, please contact BBs immediately. We will do our best to have your order completed as soon as practicable, at no additional cost to you. We
Liability
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. You may also be entitled to remedies that cannot be excluded under the Australian Consumer Law if any services supplied by us to you fail to meet a consumer guarantee under the Australian Consumer Law.
You acknowledge that the site is provided “as is” and that we do not make any warranty or representation as to the suitability of the site or a product for any purpose.
BBs are not liable for any losses or damages caused by this website. BBs reserve their right to refuse an order without giving a reason. BBs are not liable for losses or damages caused by any website linked to from this site.
Delivery
Unless otherwise organised, all Australian Shipping will be sent via Australia Post Satchels, Courier or in the manner that BBs determine is the safest way. The flat rate Australian Shipping is $16.95
As such, you acknowledge and agree that any person at the delivery address who receives the products is authorised by you to receive your order.
Should the weight, order size or shipping address require us to charge any additional shipping or delivery costs, prior to acceptance of the order, BBs will contact you to confirm your acceptance.
Delivery times quoted on the site are estimates only, and once the goods have left BB’s we are unable to control the delivery. Please allow extra time for important deliveries, especially during busy periods such as holidays.
After we receive confirmation of your order with full payment, your order is packed and ready for shipment within 1-3 business days. All orders are shipped promptly from our warehouse and delivered to most Australian cities within 3-7 working days. For remote areas, this time may take up to 10 days.
Pricing
BB’s reserve the right to change prices without notice. However, the price on the order is the price you will be charged.
All prices are quoted in Australian dollars and credit cards are charged in Australian dollars. All prices are listed inclusive of GST.
Returns Policy
As per our ‘Liability’ clause, BBs acknowledge our legal responsibilities regarding product returns. We will always aim to ensure customer satisfaction and to do so, we include the following information to make it clear and easy.
Claims for damaged or defective goods or incorrect delivery must be made within three business days of delivery. Where any goods are returned to the manufacturer or supplier, they remain at your risk pending acceptance of liability by the manufacturer or supplier. Goods that have been found to have manufacturing defects will be replaced at no charge or a credit to your account. These goods MUST be accompanied by the relevant invoice or receipt.
Without limiting in anyway the application of the preceding paragraph, BBs will not replace foil balloons which have been:
- Overblown (as indicated by tears along the seam area) burned, or have puncture holes, poorly sealed (as evidenced by wrinkles in the neck of a heat-sealed balloon when supplied flat), exposed to moisture of any form, roughly handled, improperly stored, or balloons exposed to high temperatures or direct sunlight.
- Any returns arriving COD or collect will be refused.
- Seasonal items will not be accepted for return after end of the particular season. The restocking charge will be fifteen percent of the value of the returned goods with a minimum restocking charge of ten dollars; and
- Part packages will not be accepted for return.
BBs do not accept any liability or make any warranty in relation to the goods except as provided herein or as required by law. Under no circumstances shall our liability exceed the purchase price of the goods. BBs will not be liable for any loss or damage which is consequential, indirect or due to circumstances beyond our reasonable control.

Intellectual Property Rights
You:
(a) acknowledge that the copyright in the Site, the software, design, text and graphics comprised in the Site, the selection and layout of the Site and the content and materials on the Site (together, the “Materials”) are owned by or licensed to BB’s;
(b) must not modify, copy, adapt, store in a retrieval system, reproduce, upload, post, transmit, sell, distribute in any way or communicate to the public a Material without our prior written consent; and
(c) must not frame or embed in another website any of the material appearing on this Site without our prior written consent.
Any designs of creative works such as bouquets or balloon arrangements remain the property of BBs and may not be copied for commercial purposes without prior written consent.
General
We may make changes to these Terms & Conditions from time to time. Modifications will take effect as soon as they are posted.
The site may contain links to external websites that are not operated by us. These links are provided for your convenience only and you agree that:
(a) we make no representations or warranties, or have any responsibility or liability for those websites; and
(b) these links do not indicate, expressly or impliedly, that we endorse the site or the products or services that are provided at those sites.
